This is a public auction conducted in accordance with these Terms of Sale by Legend-Morphy (hereinafter "LM").
Terms of Sale
When bidding on any lot offered by LM, the bidder indicates acceptance of the following Terms of Sale. LM has the right to modify and alter these Terms and Conditions of Sale at any time. Bidders are to comply with the Terms and Conditions of Sale posted on Legendmorphy.com at the time of the auction in which they are participating.
Condition of Items
This is not an approval sale. All lots sold to the highest bidder are final. Bidders are strongly advised and encouraged to research the lots being offered prior to the beginning of any auction. Bidder assumes all risks concerning and related to the grade, quality and origin of any lot. Bidders should determine bids based upon their own evaluation. Bidders acknowledge that coin grading is not an exact science; it is possible that two parties might grade the same coin differently. LM Rare Coin Auctions makes every effort to accurately describe all items offered in its sales, however all items for sale are "as is," and it is the bidder's responsibility (present or absentee bidders) to determine the exact condition of each item. All items will be available for preview prior to the auction.
Buyer's Premium
A 15% buyer's premium will be added to all successful bids and is payable by the purchaser as part of the total purchase cost. Credit cards and PayPal payments are accepted for purchases up to $2,500.00. All items are to be paid for in full at the close of the auction. Morphy Auctions reserves the right to hold items paid for by personal check until said check clears. Purchases made via Live Auctioneers/ Legend- Morphy LIVE bidding platforms will incur a 15% buyer's premium
Sales Tax
Effective Sept. 4, 2006 there is no PA state sales tax on investment coins and investment bullion in the state of Pennsylvania.
Payment
All merchandise must be paid for within TEN (10) days of the date of sale-no exceptions. We reserve the right to cancel any unpaid order after that time and to void the bidder from future sales. Credit cards (Visa, MasterCard and Discover) are accepted for auction payments up to $2,500.00 per invoice. Balances over $2,500.00 must be paid via personal or certified check, money order or wired funds. Personal checks, money orders and cashier's checks are accepted but will be held for 10 business days to clear appropriate banking channels before items are shipped (unless references are provided). Post-Sale Return Policy
All lots are sold "as is." Lots graded by PCGS, NGC or other third-party grading service, or any lot viewed by the buyer prior to the auction, may not be returned. Every effort is made to insure our descriptions are accurate and that they fully disclose any exceptions to condition. Buyers who wish to report a problem with a non-certified coin purchase they have made and not viewed prior to the auction must notify LM Rare Coin Auctions within three (3) days of receipt of their purchased item. If a return is authorized by LM, the item in question must be shipped, with full insurance, so it arrives in LM Rare Coin Auctions' possession within one week of the aforementioned authorization. With respect to all returns, it is the buyer's responsibility to cover the cost of shipment and insurance. Absolutely NO returns will be accepted on any item that was not paid for within 10 days of the sale date.
Shipping
Shipping costs will be billed separately and are non-refundable. Items will ship within 5-10 business days after payment is received. Coins will be shipped via Fed Ex or USPS.
NOTE: This shipping charge includes fees for our third-party insurance coverage, as well as any costs incurred to insure through the USPS or Federal Express. Any shipments made via armored carrier (Brinks, Dunbar, etc.) will be calculated at the time of shipment.
International Shipping
It is not possible for LM Rare Coin Auctions to ship to certain countries. Please email questions in this regard to info@legendmorphy.com. Payment for all international orders must be in US funds. Please contact info@legendmorphy.com for bank-wiring instructions.
NOTE: Abiding by customs requirements for each country is the responsibility of the buyer. All packages shipped outside of the United States will have the required customs declaration and reflect the full value of the order.
Absentee Bids
LM Rare Coin Auctions will accept absentee bids if pre-authorized by mail or fax. Absentee bidders must use the absentee bid form and clearly mark the lot number, title and maximum bid. Absentee bidding forms may be accessed online. If there are two (2) identical bids from absentee bidders on the same lot, priority will be given to first bid received. Absentee bids will be rounded to the next bid increment. Bidders may also preview, register and place bids online through our website. During the live sale, the auctioneer will execute your absentee bid competitively up to the maximum amount you have indicated. Online bidding through Morphy LIVE and LiveAuctioneers is also available; Terms and Conditions still apply.
Bids Via Telephone
An absentee bidder may also participate live during the auction via telephone. The absentee form must be completed in full with a request for phone bidding. Requests for phone lines must be received at least 3 days prior to the auction date. Please call 717-335-3435 to request a call from one of our representatives during the live auction. LM Rare Coin Auctions cannot guarantee phone lines, but will make every attempt to accommodate those who wish to participate via that method.
Rights & Responsibilities
The auctioneer will determine the highest bidder. The auctioneer alone has the right to reopen the bidding of an item if deemed necessary due to a dispute. LM and its representatives reserve the right to remove any attendees who impede the preview and/or the auction. Title to all merchandise shall pass to the highest bidder at the fall of the auctioneer's hammer. The buyer will then assume all risk and full responsibility of the lot purchased once ownership has changed. LM will not be responsible for any errors made by the bidder when placing bid amounts. To have a bid removed or corrected you must contact LM prior to end of the auction. Bidders will be held responsible for their bids, including those bids placed incorrectly. PLEASE VERIFY BIDS BEFORE SUBMITTING. Bidder acknowledges and waives auctioneer's responsibility for failure to realize any lost or missing bids by Internet, telephone, fax, mail or other means. The auctioneer may decline or miss floor bids, book bids, Internet bids, telephone bids or bids placed through any other means, and the bidder waives the auctioneer's liability for execution of these bids. LM reserves the right to postpone or cancel an auction without notice. Lot(s) may be withdrawn at LM's discretion without prior notice, or until the close of sale. Lots may carry a reserve. A reserve is a confidential price or bid below which the auctioneer will not sell an item or will re-purchase on behalf of the consignor or for LM. This auction company permits bids to be placed by the auctioneer, or an employee of the auctioneer, up to the pre-determined reserve set by the consignor. Legend-
